Bankruptcy Specialist is responsible for the documentation and filing of loan bankruptcy materials with the appropriate attorneys. Ensures full compliance with loan bankruptcy regulations. Being a Bankruptcy Specialist monitors accounts throughout the loan bankruptcy process and contacts appropriate party when necessary. Verifies the bankruptcy is secured and acquires a copy of the proposed Chapter 13 Plan on all secured accounts. Additionally, Bankruptcy Specialist captures Chapter 7 reaffirmation agreements to management for approval. Distributes account balances and interest rates to the secured and unsecured balances. Stays current with changing state specific bankruptcy laws. Typically requires a bachelor's degree or its equivalent. Typically reports to a supervisor. The Bankruptcy Specialist works on projects/matters of limited complexity in a support role. Work is closely managed. To be a Bankruptcy Specialist typically requires 0-2 years of related experience.     Role Summary:

    Reporting to the Collections & Loss Mitigation Manager/Team Leader, the Bankruptcy Specialist is responsible for all loan portfolios through the current bankruptcy processes. The Bankruptcy Specialist works with members and/or bankruptcy attorneys to make sure all deadlines are met, and other tasks assigned by the Collections & Loss Mitigation Manager/Team Leader, the VP of Collections & Loan Servicing, or the EVP Member Support and Service Administration.

     

    What You Will Be Doing:

    1. Responsible for developing a working relationship with bankruptcy courts, counsel, and the board of trustees.
    2. Able to research account issues as necessary and demonstrate effective problem-solving skills.
    3. Process all bankruptcy accounts in accordance with policies, procedures, and processes in place.
    4. Analyze and reconcile files to ensure proper posting of trustee payments.
    5. Perform final reconciliations as bankruptcy accounts are discharged, dismissed, paid in full, etc.
    6. Process and file proof of claim with the court. Bankruptcy claims will be filed electronically.
    7. The Bankruptcy Specialist will make sure all assets are correctly reported and work with necessary parties regarding collection efforts.
    8. Audit bankruptcy files for compliance with federal and state regulations.
    9. Responsible for monitoring internal bankruptcies processing errors and collaborating with the team member and/or department to find common resolution.
    10. Maintain working relationships with counsel and/or third-party vendors to file necessary court documents to protect credit union assets.
    11. Ability to read, understand, and analyze loan and bankruptcy information to determine appropriate actions.
    12. Must understand and perform Bank Secrecy Act (BSA) functions, as applicable to job responsibilities.
    13.  Attend credit union training sessions, conferences, or seminars as approved by supervisor. 
    14.  Maintain awareness and adhere to all policies and regulations established by the credit union.
    15. Processes loan payments including bankruptcy and collection agency payments for posting. 
    16. Maintains a high level of confidentiality within the accounts control function and administrative offices relative to any information received directly or indirectly at all times.
    17. Maintains effective oral and written communication with all credit union members, vendors, and internal team members to ensure coordination and exchange of information for accomplishing credit union goals and objectives.
    18. Works independently and as a team member while making recommendations and using sound judgment.
    19. Attends work-related courses and seminars and pursues a program of self-development.
    20. Contributes to effective department and credit union operations by performing other related duties as assigned.  Reviews and improves work methods and standards to increase efficiency.
    21. Inform manager of any documentation issues including missing documentation, and/or need for follow up.
    22. All other duties as assigned.

    Qualifications


    What You Will Need:

    1. High school diploma or equivalent required.
    2. Basic knowledge of Collections practices and the law as it applies to the collection of delinquent accounts and bankruptcies.
    3. General office skills including typing, filing, and professional telephone skills.
    4. PC skills including the following Microsoft suite software applications: word processing (Word) and spreadsheets (Excel).
    5. Ability to prioritize assignments and handle multiple tasks at one time.
    6. Ability to complete assignments with a high level of accuracy and attention to detail.
    7. Ability to maintain confidentiality.
    8. Ability to work independently with minimum supervision and be a team player.
    9. Ability to maintain a positive and professional image through effective verbal and written communication.
    10. Ability to assist members, vendors, and staff effectively.
    11. Ability to handle oneself in stressful situations.
