    NY HELPS
    This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS).

    For the duration of the NY HELPS Program, this title maybe filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply. At this time, agencies may recruit and hire employees by making temporary appointments. In May 2024, if a temporary NY HELPS employee is satisfactorily performing in the position, the appointment will be changed from temporary pending Civil Service Commission Action to permanent non-competitive and the official probationary period will begin.

    At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified.

    NON-COMPETITIVE MINIMUM QUALIFICATIONS:
    To be considered for appointment through NY HELPS, or 55 b/c, candidates must meet the open-competitive minimum qualifications for this position. The qualifications are:
    • Must have a New York State license and registration to practice pharmacy AND two years of post-licensure experience as a pharmacist.

    COMPETITIVE MINIMUM QUALIFICATIONS:

    55b/c Appointment: This position is eligible for 55b/c designation and candidates with 55b/c eligibility are encouraged to apply. Candidates must possess a current 55b/c eligibility letter and the following minimum qualifications:
    • Must have a New York State license and registration to practice pharmacy AND two years of post-licensure experience as a pharmacist.

    It is essential that candidates clearly and concisely indicate exactly how they meet the above minimum qualifications in their resume. Failure to show how you meet the minimum qualifications above may result in disqualification and removal from consideration.
    Duties Description
    The New York State Education Department’s (NYSED) Office of the Professions (OP) is seeking candidates for a Pharmacy Consultant position in the Office of Professional Discipline (OPD). Reporting to the Director, Division of Investigations, M-4, the incumbent of this position will be responsible for performing inspections, investigations and audits of pharmacies throughout New York State, with specific attention to sterile compounding, to ensure that services provided meet professional standards of practice, appropriateness, quality and comply with State, federal, and local statutes and regulations. Duties of this position include, but are not limited to, the following:

    • Conduct and facilitate on-site surveys independently or as part of a team by observing and evaluating pharmacy establishment against established standards; interviewing staff and reviewing records; investigating incidents and complaints; and investigating and gathering information on facility operations;
    • Evaluate pharmacy establishments utilizing applicable laws and regulations;
    • Make recommendations regarding licensure or certification; surveillance, review, investigation and audit findings; recommend corrective measures; and sanctions or enforcement actions;
    • Draft and review Statements or Notices of Deficiencies, Plans of Correction, investigative reports, and survey information against statewide standards for consistency and quality assurance;
    • Provide staff support and gather data needed to recommend enforcement or sanctions regarding facility and provider licensing decisions;
    • Clarify survey protocols and evaluate facility applications for the provision of services;
    • Serve as a specialist and/or clinical expert based upon licensure as a pharmacist. Provide training and oversight to team members or unit staff regarding pharmacy laws and rules;
    • Provide pharmaceutical expertise to program area staff members, including pharmacological research and consultation on projects relating to drugs, pharmacy and public health concerns;
    • Develop State policy and clinical and programmatic guidelines for pharmacy surveillance;
    • Make recommendations on enforcement and sanction actions against regulated or approved providers;
    • Provide pharmaceutical expert testimony in administrative hearings;
    • Develop, review, recommend, and implement statewide investigative and regulatory policies and procedures related to pharmacy inspections, taking into account State, federal and local laws regulations, and program operations;
    • Coordinate enforcement activities regarding health facility violations resulting from surveys, medical reviews, audits, and/or investigations;
    • Participate in the on-site evaluation of pharmacies as part of an audit team;
    • Review compliance investigation reports and facility plans of correction to ensure that deficiencies are appropriately documented and meet federal and State requirements;
    • Monitor regional inspection schedules, inspection processes, and outcomes to ensure that inspections are completed in a timely manner;
    • Monitor and evaluate regional inspection data to insure statewide and regional consistency in the application and enforcement of laws, regulations, and other requirements,
    • Work cooperatively with central and regional office managers to identify staff development needs, develop training curriculum, and administer training programs, and
    • Serve as liaison between appropriate State and federal agencies with regard to pharmacy inspections.
    Additional Comments
    CONDITIONS OF EMPLOYMENT:

    This will be a contingent permanent, competitive appointment or a contingent permanent non-competitive appointment. At this time, agencies may recruit and hire employees by making temporary appointments. In May 2024, if a temporary NY HELPS employee is satisfactorily performing in the position, the appointment will be changed from temporary pending Civil Service Commission Action to permanent non-competitive and the official probationary period will begin. This may be a temporary provisional appointment. Provisional candidates must take the examination for Pharmacy Consultant when it is next offered and must be reachable on the resulting eligible list to maintain employment.
    For 55b/c appointment, candidates must possess the minimum qualifications, a current 55b/c eligibility letter and is subject to verification of applicant eligibility. Promotions and transfers may change appointees’ negotiating unit. Candidates should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. Verification of current license and registration and work experience will be required at the time of interview for all candidates. Candidates are required to possess a NEW York State license and registration to practice pharmacy at the time of hire. Continued employment as a Pharmacy Consultant is dependent upon maintaining a New York State license and registration to practice pharmacy. Failure to maintain a New York State license and registration to practice pharmacy will result in removal from employment. This position will require 50% Statewide travel.

    This position leads to a maximum salary of $114,444 based on annual performance advances.

    In addition to the listed base salary, this position also receives a $11,000 geographic pay differential.
