Job Summary:
As an Employment Immigration Attorney, you will be responsible for providing legal advice and representation to clients regarding their immigration needs, ensuring compliance with immigration laws and regulations. Your expertise in employment-based immigration, along with your in-depth understanding of the PERM process, will be essential in effectively advocating for clients and achieving successful outcomes.
Duties/ Responsibilities:
PERM Process and Strategy:
● Provide expert guidance on the PERM labor certification process, including
strategy development, application preparation, and filing procedures.
● Conduct case evaluations to determine eligibility for PERM applications and
advise clients on the best course of action.
● Develop comprehensive PERM strategies that align with clients' goals and
minimize potential risks and challenges.
● Review and analyze supporting documents and information to ensure compliance
with legal requirements and strengthen PERM applications.
● Draft and review PERM-related forms, notices, and responses, ensuring accuracy,
legal sufficiency, and adherence to regulatory guidelines. Employment Immigration Representation:
● Advise and represent clients in various employment-based immigration matters, including nonimmigrant visas (such as H-1B, L-1, O-1) and immigrant petitions (EB-1, EB-2, EB-3).
● Prepare and file employment-based visa petitions, labor certification applications, and other relevant forms and documents.
● Conduct legal research on complex immigration issues, statutes, regulations, and case law to provide accurate and up-to-date advice to clients.
● Prepare legal briefs, memoranda, and other legal documents to support clients' immigration cases.
● Represent clients in immigration proceedings, including responding to requests for evidence (RFEs), appeals, and interviews.
Client Management and Communication:
● Build and maintain strong relationships with clients, providing exceptional
customer service and understanding their unique immigration needs.
● Conduct client consultations, gather relevant information, and provide clear and
concise explanations of legal options and potential outcomes.
● Keep clients informed of case progress, updates, and any changes in immigration
laws or policies that may affect their cases.
● Respond to client inquiries and address concerns promptly and professionally.
Compliance and Legal Knowledge:
● Stay updated on changes in immigration laws, regulations, policies, and
procedures, particularly in the area of employment-based immigration and the
PERM process.
● Ensure compliance with all applicable laws, regulations, and ethical standards in
the practice of immigration law.
● Collaborate with colleagues to develop best practices, share knowledge, and
contribute to the overall success of the firm.
Required Skills/Abilities:
● Juris Doctor (J.D.) degree from an accredited law school.
● Active member of the NY State Bar with good standing.
● Minimum 3 years of experience practicing immigration law, with a focus on
employment-based immigration and the PERM process.
● In-depth knowledge and experience with PERM labor certification, including filing
requirements, prevailing wage determination, recruitment, and audit response
procedures.
● Strong understanding of other employment-based visa categories, such as H-1B,
L-1, O-1, EB-1, EB-2, and EB-3.
● Strong negotiation and advocacy skills.
● Professional demeanor and ability to maintain client confidentiality.
● Proficient with Microsoft Office Suite, Gsuite or related software.
Education and Experience:
● Juris Doctor (J.D.) degree from an accredited law school.
● Active member of the NY State Bar with good standing.
● Minimum of 2 years of experience practicing civil litigation law.
