    With responsibility for administration of the operation of the office under his/her jurisdiction, this position has the following delegations of authority and responsibility:

    • Receives charges, petitions for certification or decertification of representatives for collective bargaining purposes, and petitions affecting employees' membership in such labor organization; investigates all charges and petitions to ascertain the merits within the framework of the National Labor Relations Act and policies enunciated by the Board and the General Counsel, with authority to have access to and the right to copy evidence, to administer oaths and affirmations, to examine witnesses and to receive evidence; and to approve or disapprove the withdrawal of charges or petitions.
    • Manages all aspects of charges alleging Unfair Labor Practices and Notices of Hearing, including issuance and service of, or refusal to issue a complaint, subject to the right of the charging party to appeal to the General Counsel.
    • Investigates representation petitions filed and negotiates consent and stipulated election agreements between and among the various parties regarding jurisdiction, the appropriate unit and the time, place and date of election.
    • Holds hearings in representation cases consistent with Agency procedures in order to resolve questions concerning representation relevant to the holding of an election; determines and narrows the relevant issues to be litigated at a hearing by reference to a party's Statement of Position and/or the opposing party's adverse position thereto; determines which issues sought to be litigated by a party at hearing, if any, may be deferred for post-election resolution, if needed' to determine which employees, if any, are allowed to vote subject to challenge; to grant subpoenas and pass upon rulings and motions and special appeals made at hearings.
    • Makes rulings on a wide variety of matters pertaining to representation cases, under direct delegation of authority from the Board, such as rulings on request for extensions of time to file briefs, rulings with respect to showing of interest, waivers, disclaimers, withdrawals, or concurrent charges, ruling on motions to amend or rescind certifications; and to rule upon motions for reconsideration and oral argument.
    • Exercises leadership by motivating managers to incorporate vision, strategic planning, and elements of quality management into the Agency's activities; encourages creative thinking and innovation; influences others toward a spirit of service; leads or contributes to the design and/or implementation of new programs/processes based on how best to advance the mission of the agency; is open to changing and new information; tolerates ambiguity; adapts behavior and work methods in response to new information, changing conditions, or unexpected obstacles; adjusts rapidly to new situations warranting attention and resolution; provides input to any proposed changes in a positive and constructive manner that fosters diversity of thought; and identifies, implements and supports the development and launch of new programs, staffing changes, structural changes and procedures.
    • Effectively communicates and implements Agency goals and programs; motivates the workforce through leadership, effective communication with staff and local union representatives, candid exchange of ideas taking into account employee perspective, listening to and considering ideas of subordinates in a manner that fosters creativity, innovation and high-quality individual and Agency performance; appraises employees in a timely fashion using appropriate judgment in assessing their performance and providing them with constructive feedback; makes meaningful distinctions in performance rating and through the Agency's award program consistent with individual and group performance; addresses performance or other workplace challenges effectively and efficiently.
    • Monitors and evaluates programs and work practices to optimize efficiencies and prevent mismanagement and instill pubic trust. Uses information technology effectively to accomplish the Agency's mission; effectively supports the President's and Agency's initiatives to make government more efficient and effective.
    • Incumbent engages in effective outreach with customers and stakeholders as appropriate; communicates the Agency's mission, policies, and programs with parties, the labor-management bar, oversight agencies, the public, and other stakeholders, as appropriate.

    Qualifications

    THIS POSITION IS IN THE SENIOR EXECUTIVE SERVICE (SES): This is a Career-Reserved position and therefore must be filled by a career appointee. Candidates are not required to have previous SES career service before applying. The selected candidate executive/managerial qualifications must be certified by the Office of Personnel Management prior to an initial SES career appointment. Positions in the SES are ungraded.

    To qualify for this position, you must meet the following requirements:

    As a basic requirement for entry into the SES, applicants must provide evidence of progressively responsible leadership experience that is indicative of senior executive level managerial capability and directly related to the skills and abilities outlined under Professional/Technical Qualifications and Executive Core Qualifications.

    Failure to meet the basic qualification requirements and all Professional/Technical and Executive Core Qualification factors automatically eliminate the applicant from further consideration.

    ALL CANDIDATES MUST FULLY ADDRESS ALL ITEMS UNDER 'TECHNICAL QUALIFICATIONS' TO BE ELIGIBLE FOR CONSIDERATION.

    A. PROFESSIONAL/TECHNICAL QUALIFICATIONS- PTQs: A narrative statement specifically to show possession of the Professional/Technical Qualifications (PTQs). Responses should summarize the applicants experience in relation to the PTQs and specific examples of accomplishments. Total length of narratives should not exceed 3 pages.

    PTQ 1. Knowledge of the National Labor Relations Act (NLRA), as amended, related case law, and precedent in order to handle the most complex legal issues relating to the statute.
    PTQ 2. Demonstrated knowledge of the NLRB's mission and programs in order to effectively direct programs critical to carrying out the Agency's mission.
    PTQ 3. Demonstrated ability to manage the human, financial, information, and other resources of an organization, and lead staff in accomplishing the organization's strategic goals.

    B. EXECUTIVE CORE QUALIFICATIONS - ECQs: Candidates must also submit a separate narrative statement to show possession of the Executive Core Qualifications (ECQs) listed below. You are required to respond to all ECQs. If you fail to do so, you will be rated as ineligible. Total length of narratives should not exceed 10 pages.

    ECQ 5 - BUILDING COALITIONS: This core qualification involves the ability to build coalitions internally and with other Federal agencies, State and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals.     You will be evaluated for this job based on how well you meet the qualifications above.

    Applicants who are current career SES members, former career SES members with reinstatement eligibility, OPM certified graduates of a SES Candidate Development Program (CDP), or who otherwise meet the mandatory requirements (Executive Core Qualifications and Professional Technical Qualifications), will be considered qualified for this position.
