    Responsibilities

    At Groups, the Director of Compliance and Privacy will play a key role in our organization by leading compliance in a rapidly growing network of facilities. This role requires extensive experience with compliance with federal and state healthcare regulations. The Director of Compliance and Privacy will also help perpetuate the organization's DNA by maintaining a compliance-focused culture and an entrepreneurial attitude.

    The Director of Compliance and Privacy will be responsible for managing and coordinating compliance processes and procedures across organizational and functional areas to promote compliance with federal, state, and local laws, rules, and regulations. This position will collaborate with operational leadership and other functional areas (e.g., Training, IT, HR, Business Operations, Clinical), as well as with regulators and payers.

    Responsibilities include:

      Manage various compliance program activities at the direction of the Chief Compliance Officer and Corporate Counsel.
    • Assist in the establishing departmental goals that are consistent with, and lead to the successful achievement of, Groups's strategic objectives.
    • Assist in developing and implementation of an annual risk assessment and an annual compliance work and audit plan with the assistance of the compliance team and Compliance Committee.
    • Delegate compliance responsibilities to team members, and supervise these activities to ensure proper completion.
    • Investigate and prepare responses to audits performed by outside agencies, including but not limited to, the OCR, CMS, CMS contractors, the OIG, accreditation entities, and managed care insurance agencies.
    • Advise management on compliance issues and related opportunities for process improvements.
    • Perform internal compliance investigations and audits throughout the organization, including compiling detailed reports and making recommendations on corrective actions to senior management.
    • Perform compliance investigations and audits on vendors, as applicable.
    • Maintain current knowledge of relevant regulatory and subregulatory guidelines, pertinent regulations, and government enforcement initiatives.
    • Monitor regulatory developments relating to company operations and advise applicable departments as needed.
    • Continually assess the effectiveness of departmental functioning, including the people, processes and technologies needed to achieve departmental and corporate goals and objectives. Identify problems and opportunities for improvement and generate creative solutions that improve qualitative and quantitative performance.
    • Assist with the development and implementation of compliance and privacy policies and procedures.
    • Serve on the company's Policy Committee and maintain the company's policy and procedures database.
    • Provide oversight in the development, implementation and monitoring of the compliance and privacy program training materials.
    • Manage and ensure company's adherence to state and federal privacy requirements including HIPAA and 42 CFR Part 2.
    • Collaborate with the IT Security team to ensure alignment between security and privacy compliance programs including policies, practices, investigations, and act as a liaison to the IT Security team.
    • Conduct and oversee privacy breach investigations, including reporting and implementing corrective actions as necessary.
    • Review Business Associate Agreements and Qualified Services Organization Agreements to ensure compliance with HIPAA and 42 CFR Part 2.
    • Provide advice to company stakeholders on matters involving healthcare privacy compliance.
    • Manage member rights processes including medical records requests and grievances.
    • Monitor, and continuously evaluate potential compliance violation reports, trends, and the resolution process.
    • Collaborate with human resources to ensure development of appropriate and consistent discipline where needed in response to compliance violations.
    • Help organize, design, implement, and present during compliance events such as Compliance Week.
    • Perform all other duties as assigned.
    Qualifications

    Experience, Education and Knowledge and Skills

    Basic Qualifications

    • Bachelor's degree required.
    • At least 5 years in the healthcare compliance industry, including previous management experience.
    • At least 3 years' experience in the behavioral health or substance use disorder fields.
    • Full understanding of the healthcare regulatory industry, with experience in conducting complex compliance investigations.
    • At least 2 years' experience developing or managing healthcare compliance programs.
    • Certification in Healthcare Compliance (CHC) or Certification in Compliance & Ethics Professional (CCEP).
    • Previous experience auditing, developing internal controls, and managing organizational risk.
    • Must have the ability to carry out non-routine procedures under constantly changing conditions.
    • Ability to deliver information accurately with insight and perspective.
    • Ability to manage multiple priorities simultaneously and consistently meet deadlines.
    • Ability to review and understand contractual requirements.
    • High-level of skill in leading interdepartmental and cross-functional projects; experience managing professional staff on multiple projects to ensure corporate deadlines and objectives are met.
    • High technical competency and skills to learn complex information and new programs.
    • Ability to accomplish goals with minimal supervision both independently and as a team member; High attention to detail; Excellent interpersonal skills; Disposition to adapt and manage change; Demonstrated initiative; Excellent writing skills; Excellent presentation skills.

    Preferred Qualifications

    • Advanced degree or JD.
    • Certification in Medical Coding or Auditing: Certified Professional Coder (CPC) or Certified Coding Specialist (CCS) or Certified Professional Medical Auditor (CPMA).
    • Certification in Healthcare Privacy Compliance (CHPC).
    • At least 2 years' experience with Medicaid.
