Researches, negotiates and elects to purchase short- and long-term lease of land agreements and right of way for construction that meet the organization's goals. Being a Right of Way Agent handles all land related legal issues, including transfers of titles and deeds, construction, mortgage concerns, and zoning. Prepares resolutions and other legal forms related to land acquisitions. Additionally, Right of Way Agent may require a bachelor's degree. Typically reports to a supervisor or manager. The Right of Way Agent contributes to moderately complex aspects of a project. Work is generally independent and collaborative in nature. The purpose of this class is to manage the County’s subdivision regulations and acquisition and sale of real estate for the county.
- Administers the County Subdivision Regulations and review subdivision plats and construction plans.
- Gathers and analyzes data, prepares reports, legal descriptions and documents relating to easements, rights-of-way, and other property rights.
- Responds to County citizens inquiries regarding County right-of-way issues.
- Issues permits for work within County right-of-way.
- Conducts property research, acquire surveys, verifies existing rights-of-way, conducts public meetings, prepares Court Orders and presents to Commissioners’ Court.
- Meets with property owners, engineers, and surveyors, with questions regarding subdivision of property.
- Acquire real estate for special county projects.
- Review appraisals and title reports.
- Resolve encroachment issues.
- Prepare in-house estimates for the acquisition of easements.
- Acquire or dispose of property rights including coordinating the work of appraisers, engineers, surveyors, land title agents and engineering staff. Coordinate requisition of purchase orders and payment of invoices for professional services.
- Process and respond to requests for abandonment of county right-of-way.
- Arrange the issuance of checks and effects payment for rights-of-way and departmental expenses.
- Assist in the preparation of the annual budget.
- Performs related work as assigned.
- Requires High School diploma or GED equivalent.
- Requires four years of experience in property acquisition, subdivision platting, appraisals, metes and bounds, surveys or closely related experience.
- Physical demands refer to the requirements for physical exertion and coordination of limb and body movement.
- Unavoidable hazards refer to the job conditions that may lead to injury or health hazards even though precautions have been taken.
- The work is typically performed sitting at a desk or table or while intermittently sitting, standing, bending, crouching, or stooping. The employee occasionally lifts light and heavy objects.
- The work is typically performed in an office and outdoors, occasionally in cold or inclement weather.
