Municipal Court Prosecutor

  • Job Purpose and Objectives:

    Prepares and prosecutes municipal court cases for the City of Emporia.

    Job Competencies: Essential Functions include the following. Duties and responsibilities, as required by business necessity may be added, deleted, or changed at any time at the discretion of management, formally or informally, either verbally or in writing. Schedule and shift assignments and work location may be changed at any time, as required by business necessity.

    • Prosecutes all traffic, criminal code, zoning and other code violations in Emporia Municipal Court
    • Prosecutes appeals in Lyon County District Court
    • Coordinates with city staff to ensure proper scheduling and timely prosecution of cases
    • Conducts legal and technical research and analysis related to court cases
    • Reviews police reports, witness statements and physical or documentary evidence and determines legal sufficiency of evidence for appropriate criminal charges
    • Drafts court documents including motions, answers and appellate briefs
    • Provides discovery and negotiates plea arrangements with attorneys and pro se defendants
    • Appears in court to try cases, argue motions, make sentencing recommendations and perform other court duties
    • Provides legal opinions and training to police and court staff in criminal matters and procedures related to the municipal court
    • Maintains regular office hours with availability to meet with attorneys, pro se defendants, victims, witnesses, advocates or members of the public
    • Coordinates victim, witness and police interviews and appearances
    • Manages the pre-trial diversion program including establishing and implementing policies, setting criteria and penalties, drafting applications and diversion agreements and monitoring progress
    • Maintains confidentiality of files, records, reports and other information as required by law or policy
    • Participates in CCRT/SART multi-disciplinary domestic violence prevention team
    • Collaborates with City Attorney on amendments to Emporia municipal code
    • Substitutes for the City Attorney as needed
    • Enforces and maintains compliance with all federal, state, and local laws and ordinances
    • Performs other duties as assigned or deemed necessary
    • Complies with all organizational and departmental policies and procedures
    • Operates all job-related equipment, machinery, tools and other aids as required or needed
    • Protects and maintains any confidential information, whether oral, written, or electronic

    Position Requirements:

    1. High school diploma or other equivalent

    2. 2 years Criminal Defense or prosecution is preferred

    3. Juris Doctorate Degree from a law school accredited by the American Bar Association

    Skills/Knowledge/Abilities:

    1. Knowledge of Kansas criminal law, city ordinances and general municipal law

    2. Ability to understand and apply the rules of evidence and criminal procedure

    3. Knowledge of victim issues and rights

    4. Ability to speak in public in front of groups of diverse individuals

    5. Skill in interpersonal communication and negotiations

    6. Ability to maintain and organize a large caseload

    7. Ability to analyze legal facts, issues and cases

    8. Active listening, critical thinking, reading comprehension, complex problem solving, judgment and decision making

    9. Excellent time management skills and ability to multi-task and prioritize work

    10. Ability to fulfill all duties with minimal supervision and to work independently

    11. Assess situations rapidly and make logical decisions in a timely manner

    12. Analyze facts and exercise sound judgment

    13. Ability to effectively manage projects and multiple priorities simultaneously

    14. Strong written and verbal communication skills

    15. Problem solving and critical thinking skills

    Pay: $41,283.00 - $47,861.00 per year
