    The State of New Hampshire, Insurance Department has a full-time vacancy for Health Law and Policy Legal Counsel.

    SUMMARY:

    Administers and coordinates all legal, policy-related, and legislative objectives of the Insurance Department on matters of health law and health policy with responsibility to serve as primary legal counsel for all regulatory matters relating to major medical insurance coverage and managed care. Coordinates with federal regulatory bodies relating to health insurance and manages the legal aspects of the Department’s response to all evolving health insurance-related regulatory issues.


    MINIMUM QUALIFICATIONS:

    Education: J.D. from an American Bar Association recognized law school.

    Experience: Six years' experience in the active practice of law.

    Special Qualifications: Must be an active member of the New Hampshire Bar Association and in Good Standing.

    License/Certification: Valid driver’s license and/or access to transportation for statewide travel.

    RECOMMENDED WORK TRAITS:

    Thorough knowledge of the insurance laws and regulations of the State of New Hampshire. Knowledge of accounting and market conduct principles and practices as used in the business of insurance. Working knowledge of office methods, procedures and equipment. Ability to establish and maintain an effective working relationship with other employees, insurance company officials, other US and international regulators and the public. Ability to develop administrative and statistical reports with evidence and recommendations. Willingness to spend periods of time out-of-state. Must be willing to maintain appearance appropriate to assigned duties and responsibilities as determined by the agency appointing authority.


    RESPONSIBILITIES:

    • Develops and assists in the execution of the Department’s long range and short-term legal objectives relating to major medical insurance coverage and managed care. Determines, drafts, and implements appropriate legal and legislative responses to changing market conditions, evolving federal law and guidance, and other emerging regulatory challenges. Conducts thorough legal research to provide legal advice and regulatory solutions on matters relating to health policy and comprehensive health insurance coverage.
    • Guides the Forms Review team in completing the Qualified Health Plan (QHP) review process in compliance with the Affordable Care Act. Annually reviews the Notice of Benefit and Payment Parameters, the Letter to Issuers and other guidance from CMS and drafts the Department’s annual bulletin providing guidance to issuers. Annually provides training to LAH forms examiners on changes in federal guidance regarding the QHP review process. Researches and expeditiously resolves regulatory issues encountered by the LAH forms examiners in carrying out the QHP review process.
    • Plans, drafts, coordinates, and manages Department-requested legislation and Department rulemaking, bulletins, and other guidance concerning the regulation of major medical health insurance and managed care with consideration and a thorough understanding of relevant federal law developments and guidance and emerging market trends. Plans, drafts, coordinates, and manages Department ACA waiver applications and market stabilization initiatives relating to health insurance markets.
    • Provides legal counsel and direction to all Department staff, including Consumer Services, Health Market Conduct, Health Forms Review, Financial Examinations, Licensing, Data Analytics, and Enforcement on all matters involving the regulation of health insurance and managed care. Works closely with other members of the Health Team, the Legal Unit, and all Department staff to ensure timely identification and consistent resolution of legal and policy issues relating to major medical health insurance coverage, including individual market, small group, large group, student, and short-term major-medical coverage, as well as mechanisms designed to promote market stability.
    • Serves as the Department’s representative on intergovernmental initiatives, stakeholder forums, and community outreach events involving access to comprehensive health insurance coverage, health care accessibility, health insurance cost containment, health insurance reform, and related matters.
    • Engages in NAIC committee work, task forces, and working groups relating to health insurance and managed care to represent the Commissioner and to provide legal and technical expertise to the Commissioner, the Health Team, and Department staff on NAIC health insurance and healthcare initiatives, to include the Health Insurance and Managed Care (B) Committee, the Regulatory Framework Task Force, the ERISA Working Group, the HMO Issues Subgroup, and the Pharmacy Benefit Manager Regulatory Issues Subgroup.
    • Represents the Department before the General Court, at meetings of legislative committees and work groups on matters involving access to comprehensive health insurance coverage, health care accessibility, health insurance cost containment, health insurance reform, and other matters of policy and law related to health insurance and managed care.
    • Provides legal counsel to the Tax Unit of the Department on all matters relating to premium taxes and fees.
